Introduction.


Flamethrowers & Dreamcatchers, here after referred to as FTDC, aim to work in partnership with parents and carers to create and maintain a safe, caring, stimulating and educational environment of children in its care. All parent/guardians wishing to make use of the service offered by FTCD, must strictly adhere to the terms and conditions and sign (online: by agreeing to the terms and conditions) this document as evidence of their acceptance and agreement to the terms and conditions under which FTDC will operate.

As we aim to develop an interactive partnership with all users and schools, we would welcome suggestions and discussion on ways to improve the service we offer.

​

1. Registration Forms

​

1.1 An application form, which lists the children’s details and outlines the childcare arrangements, must be completed and signed by a parent/guardian in person in advance of any sessions. Listed must be names of responsible parties with access to the children. Also listed must be the names, addresses and telephone numbers of an emergency contacts that may be called upon in case of an emergency when parents cannot be contacted and they too must be responsible individuals. Responsible parties or individuals must be those over the age of eighteen.

2. Drop-off and collection.

​

2.1 Children may be dropped between the hours of 15:30-16:00 at the pre-agreed location booked for the session prior to the start time of 16:00

​

2.2 Late arrivals may result in the child having to wait for an appropriate entry point to the session.

​

2.3 Children registered for this service must be brought in by a parent/guardian who will register.

​

2.4 Children may be collected between 17:55-18:10 unless pre-agreed 48 hours in writing whereupon arrangements for late collection will be made.

​

2.5 Children may only be collected by parents/guardians registered with FTDC and known to the children.

​

2.6 Please note if you are late picking up your child at the pre-arranged time a fee of £5 will be charged for every 5 minutes late to cover the cost of staff unless otherwise.

3. Attendance.

​

3.1 Children are expected to attend weekly at the arranged time and date accordingly laid out by their membership or drop-in, however, should a child become ill or cannot attend for any reason 48hours notice must be given to FTDC or the class will be charged in full.

​

4. Emergency contacts and access.


4.1 Parents/guardians must ensure that emergency contact and persons with access in accordance with the above are familiar with the necessary procedures. In cases of emergency and parents/guardians cannot be contacted, FTDC will get in touch with an emergency contact named. He or she will then take on responsibility for the children.

​

Persons with access may collect children in accordance with 2.5 above.

​

FTDC must be notified immediately of any change of details to emergency contacts and/or their telephone number.

​

5. Fees


5.1 Full fees will be payable unless written notification of discounts has been made.

​

5.2 Fees are payable in advance of sessions, either online or in person on site and on the day.

​

5.3 Membership fees must be paid in full 24 hours prior to the first session unless otherwise agreed in writing.

​

5.4 Drop-ins may be paid on the day in person.

​

5.5 Reservations must be paid for in advance to secure booking, reservations may be taken without payment but without guarantee that the space will be held.

​

5.6 FTDC reserve the right not to admit children for whom fees are in arrears. In the event of arrears accumulating, management will discuss this with you and if these are not settled within agreed time limits, the children’s place will be withdrawn and legal action will be pursued to retrieve payment, by which time you will be responsible for any costs incurred in the process.

​

5.7 Fees are payable at all times including absenteeism due to illness or for any other reason. In the rare event that FTDC has to close due to extreme weather conditions that pose a health and safety risk, fees will not be refunded.

​

5.8 FTDC reserves the right to increase its fees; it is unlikely that fees will increase more than once annually.

​

5.9 Refunds for payments made prior to commencement of the child’s session, within the 48hour cancellation window, must be made in writing either by email or by post.

 

5.10 Full refunds may be processed at the discretion of FTDC due to extenuating circumstances.

 

6. Photographs and other media

 

6.1 No video, photographs or other media recording may be taken of children without express written consent of the child’s parent/guardian.

 

7. Intellectual Property

 

7.1 All games, game mechanics, story arcs/adventures and characters, with the exception of characters created by the children and materials otherwise already under copyright and owned, are the sole intellectual property of FTDC and may not be duplicated, replicated or sold without express written permission of the owner.

 

7.2 Characters created by the children are property of the child who created the character and they may use that character and its likeness in anyway they see fit.

 

7.3 The Flamethrowers and Dreamcatchers name and logo is property of FTDC and may not be duplicated without written permission of the owner.

 

8. Medical Health

​

8.1 A staff member trained in emergency paediatric first aid will be on site at all times as specified by U.K law.

 

8.2 FTDC will not admit children suffering with any infectious disease or virus. FTDC reserve the right not to administer medicine, however, a request to administer medicine will be considered on an individual basis. Children who have been suffering with an infectious disease or virus will not be re-admitted unless a doctor’s letter is presented stating that the child has made full recovery.

 

8.3 Parents/guardians must sign a form of authority in the event of emergency hospital treatment becoming necessary. Staff shall administrate minor first aid as and when necessary.

 

8.4 FTDC must be informed in writing of any special dietary requirements or allergies to food substances.

 

9. Complaint procedure


9.1 It is hoped that parents/guardians will not have to complain about any aspect of the service we provide, however, should the need arise, there are three stages at which complaints can be considered.

Stage 1 – The Informal Resolution
Discuss your complaint with the relevant staff member. If you are still dissatisfied you may discuss the matter with the manager. It is hoped that the matter may be resolved to all parties at this stage.

​

Stage 2 – Formal Complaint to Management
If unresolved at the Informal Stage, the complaint should be sent in writing to the manager. You will then receive a written request to attend a meeting with management to discuss the matter.

​

Stage 3 – Formal Complaint to OFSTED
This stage is to be used if the outcome of stage 2 is not satisfactory. A written complaint should be set out and sent to OFSTED, Royal Exchange Buildings, St Ann’s Square, Manchester, M2 7LA.

10. Violence At Work

​

10.1 Violence against any FTDC personnel will not be tolerated and will result in the loss of your children’s place. A working definition of violence at work is ‘any incident where an employee is abused, threatened or assaulted by a member of the public, parent or child cared for by FTDC in circumstances arising out of the course of his/her employment.’


Violence will be deemed to include physical force, verbal abuse with threats, rude gestures, and innuendoes, sexual or racial harassment.

10.2 FTDC reserve the right to pursue legal action and damages for any violence inflicted on employees.

​

11. Termination

​

11.1 The contract will last for a period as agreed by the length of sessions booked - 12 weeks from commencement of block date for full membership and 6 weeks for 6 week membership, 3 weeks for the 3 week Christmas package and for the duration of the Drop In session for single booked sessions. However, during this period FTDC reserve the absolute right to terminate this agreement with immediate effect, in the event that any of the clauses listed in these terms and conditions are broken.

12. Privacy Policy

​

12.1 When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

​

When you browse our store, we also automatically receive your computer's IP address in order to provide us with information that helps us learn about your browser and operating system.

​

12.2 Email Marketing: With your permission, we may send you emails about our store, new products and other updates.

​

12.3 Consent: When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

12.5 Disclosure: We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

12.6 Wix.com: Our store is hosted by Wix.com. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Wix.com's data storage, databases and the general Wix.com application. They store your data on a secure server behind a firewall.

 

12.7 Payment: If you choose a direct payment gateway to complete your purchase, then our third-party payment gateway might use your credit card info for that purpose. See 12.8.

 

12.8 Third-Party Services: In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

12.9 Links: When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

12.10 Security: To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.

12.11 Age of Consent: By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

13. Changes to these terms of service

We reserve the right to modify our terms of service at any time, so please review it frequently.

Changes and clarifications will take effect immediately upon their posting on the website.

If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
